TERMS AND CONDITIONS FOR GORE VILLA HOUSES
AT TRYALL AND SILVER SANDS..
Introduction
GORE VILLAS is a private company, owned
by a Jamaican family
and dedicated to providing its clients
the very best holiday accommodation in
a private home.
Making a Reservation
To book your accommodation, you will need
to complete our Reservation
Form and pay a deposit or the full
amount if you are booking within thirty
days of the start of your booking period.
The person submitting the Reservation
Form is called the Party Leader. He
or she must have the authority to contract
on behalf of all other persons utilizing
the accommodation and other services booked.
By submitting the Reservation Form, the
Party Leader is stating that all persons
utilizing our services have accepted these
Terms and Conditions. The Party Leader
will be responsible for the full cost
of accommodation and other services contracted.
Confirmation
A Confirmation with all necessary details
will be issued and sent to the Party Leader
who is responsible for keeping other members
of the party informed. Our responsibility
is to provide the accommodation and other
services that you have booked with us.
Please check your Confirmation carefully
to ensure that you have been confirmed
for what you intended to book. We reserve
the right at our absolute discretion to
refuse your booking, in which case we
will refund in full any money you have
already paid us.
What
Is And Is Not Included
Rates include current local taxes, staff
salaries, laundry, cost of water and electricity,
cleaning and household supplies. The accommodation
is fully furnished and equipped with all
necessary linen, bath and beach towels,
dishes, utensils, soaps and tissue paper.
Unless you choose otherwise, we will stock
an initial supply of groceries on an account
in your name at the local supermarket
so that a meal or refreshments are available
upon your arrival. Anything from the initial
supply not opened or used may be returned
for a full credit. This does not apply
to your subsequent purchases made after
you arrive. Rates do not include any insurance,
flights, airport charges, car rental,
transportation (except where one set of
Airport Transfers to and from Montego
Bay are included free with the accommodation),
baggage handling, staff gratuities, telephone
charges, food, beverages, liquor, personal
items and expenses, dry cleaning, and
baby-sitting.
Airport
Transfers
Airport Transfers to and from Montego
Bay are included in the Weekly Package
Rates for the villas and cottages. We
allow for two suitcases per passenger,
and we are under no obligation to transfer
windsurfers, surfboards, bicycles or other
unconventional luggage. If you have such
luggage, please inquire. This is a private
transfer. There is no waiting around.
Once you clear Customs, you are met by
our Rep and/or driver and you are on your
way. There are no stops at other villas,
resorts or hotels on the way. You are
responsible for ensuring that your children
are securely fastened in child seats throughout
the journey.
Booking
Lesser Bedrooms Than the House Contains
Some homes permit guests to book a lesser
number of bedrooms than the house contains.
Those not booked are closed off. The rest
of the unit is yours exclusively for the
duration of your stay. No one else will
share any part of the accommodation with
you. The maximum number of persons allowed
per bedroom is two. Additional persons
may be allowed at an extra cost. Under
no circumstances will more persons be
allowed to occupy the accommodation than
the number stated on the Confirmation.
An infant (i.e. a child who is less than
two years old) may share a bedroom at
no extra charge.
Payments
A reservation may only be confirmed when
the Reservation Form has been submitted
and a 20% deposit has been received by
Gore Villas. The balance is due no less
than 30 days prior to the start of the
booking period. If the booking is made
less than 30 days prior to the start of
the booking period, the entire amount
is due immediately.
Travel
Insurance
Gore Villas highly recommends you obtain
travel insurance, including trip cancellation
insurance. One of your party may become
ill and unable to travel, and sometimes
there are other events beyond your control.
Refunds
Your payments will only be refunded if
(1) Gore Villas is unable to provide the
services or accommodation (e.g. damage
to the property) in which case you get
a full refund; (2) Gore Villas is able
to rebook the villa for the period you
booked, in which case you get a refund
less US$50 service charge. There is no
refund under any circumstances for any
unused portion of booked accommodation
or services. Cancellation of your booking
may result in the forfeiture of your payments.
Building
Work and Nuisance
From time to time, building work and associated
noise is unavoidable near to your accommodation.
This is not under our control and we may
not receive advance notice of this. Please
let us know if you are having a problem
with building work and associated noise
or any other nuisance.
Maintenance
of your Private Home
Like your own private home, things may
go wrong at any time. We will do our best
to ensure that any necessary maintenance
work is carried out as quickly as possible
to cause you minimum inconvenience. However,
like your own home, it is not always possible
to arrange for someone to immediately
repair or replace broken or damaged equipment
and other items.
Utilities
like Electricity, Water, and Telephone
Like in many countries these utilities
sometimes do malfunction and there may
be interruptions in their supply. This
is of course beyond our control and we
do not provide any compensation for such
occurrences. Our homes have reserve water
tanks and emergency lighting. Should there
be a disruption of these utilities, we
ask for your patience and understanding.
Cable
Television
Gore Villa homes are provided with this
service. However these services are sometimes
unreliable and no refunds or compensation
of any kind can be made for the failure
or bad reception of cable television systems.
Weekly
Prices
Each vacation home is individually priced,
reflecting the fact that they are both
different and their owners have the final
say in the setting of the price. The prices
for the villas are displayed on the rates
page of each home. All the homes are priced
by the week (a stay of seven nights).
You may of course stay for more than a
week. A stay of a week or more in one
home includes Free Airport Transfers between
Montego Bay and Silver Sands, or Tryall,
that is one pick-up and one drop-off for
all members of your party travelling together.
Note, if you stay more than a week in
total, but you have spread your time over
more than one home, the Airport Transfers
are not included unless you spend at least
a week in one of the homes. A stay of
less than a week does not include Free
Airport Transfers. We can arrange these
for you at our usual rates.
Maximum
Number of Persons Allowed
Note, that the prices are based on a maximum
of two persons sharing a bedroom. For
example, our four bedroom villa will accommodate
up to eight persons. An infant, i.e. a
child who is less than two years old at
the time of the occupation of the home,
may share an adult's bedroom at no extra
charge. Extra persons, i.e. more than
the maximum allowed under these guidelines,
are NOT permitted to stay in the homes
UNLESS prior permission is obtained in
writing and reflected on your Printed
Confirmation. There is usually a charge
of US$25 per night for each additional
person. If your party consists of more
than the maximum number allowed for the
rental in which you are interested, please
inquire. Under no circumstances, will
extra persons be permitted to stay in
the homes without prior written permission.
Price
Guarantee
Subject to the following, rate changes
made after you have booked will not affect
the price you pay, i.e. the price at which
you booked is guaranteed. Prior to your
making a reservation, the rates are subject
to change without notice. Jamaican Government
Taxes are included in the prices, however
if any new Government Tax or Levy is imposed,
we reserve the right to pass these costs
on to you.
If
You Want to Make Changes to Your Reservation
If after making your booking, you wish
to make any changes, please give us as
much notice as possible. You may substitute
persons who may have dropped out without
any penalty or charge. If you must change
dates, we shall revise your booking provided
the home you booked is available for the
new dates. It is not always possible to
switch from one home to another after
your booking has been confirmed, as we
reserve our private villa for your exclusive
use. We will however do our best to be
flexible to accommodate your changes.
Since we do incur additional costs in
revising your booking, there will be an
administrative fee of US$15. If however,
the change you make increases the value
of your booking by more than US$15, we
shall absorb this administrative fee and
there will be no additional charge.
If
We Need to Make Changes to Your Reservation
After confirming your booking, it may
become necessary to make changes to your
booking or to cancel it and we reserve
the right to do so. We will tell you of
any changes as soon as reasonably possible.
Where we are unable to provide the accommodation
(e.g. the home may have developed a serious
maintenance problem), we shall offer you
a full refund or alternative accommodation
of a similar quality (if available). If
we advise you of a change, you must let
us know as soon as possible if you wish
to accept the change or cancel the booking
for a full refund.
Termination
You are responsible for the proper conduct
of yourself and any members of your party
during your stay. In cases of serious
misconduct, Gore Villas reserves the right
to terminate your booking or that of any
member of your party. If we do so, we
shall have no further responsibility or
liability to you. If you or any member
of your party deliberately or negligently
cause any loss or damage to any accommodation,
property or person, you agree to compensate
Gore Villas for any loss suffered by us,
including legal costs, arising from such
damage.
Breakage
and Damages
Save for fair wear and tear, you are responsible
for the condition of the home and its
contents. While we do not secure a deposit
against damages, we reserve the right
to charge you for damages and breakages
that are out of keeping with the norm.
Check-in
and Check-out
While we are flexible with check-in and
check-out times, the official check-in
time is 2:00 PM and the official check-out
time is 10:00 AM. As long as your accommodation
is available, you may check in as early
as 9:00 AM or check out as late as 5:00
PM at no extra charge. If the accommodation
is needed for another party, we will provide
a courtesy room and bathroom in another
home, if available, for your use at no
extra charge. If you need to check in
before 9:00 AM or check out after 5:00
PM and it is possible for us to allow
you to occupy the accommodation, there
will be an incidental charge of US$50;
if you need to check out after 8:00 PM,
you will be charged for an additional
night.
Liability
GORE VILLAS is not responsible in any
way whatsoever for any damage, loss, expense,
injury, or death arising in connection
with the provision of any service or the
rental of any accommodation or equipment
including water sports equipment, or arising
in connection with any airline, vessel
or ground carrier, or for the action or
omission of any travel agency or tour
operator, or their agents. GORE VILLAS
is not responsible in any way whatsoever
for any damage, loss, delay, harm or expense
resulting from inclement weather,hurricanes,
acts of terrorism, acts of God, labour
unrest, monetary crisis, theft, quarantine
restrictions, civil commotion, arrest
or restraint by any government, the hazards
of war, or any conditions outside of its
control.
Complaints
If you have a complaint, you must tell
our local Management immediately so we
have the opportunity to deal with it forthwith.
If you do not tell us about your complaint
immediately, our ability to investigate
it could be seriously hampered, so unless
there is a valid reason why you didn't
tell us about your complaint at the time,
we will not deal with it.
